Website terms
Version 1.0 · in force from 1 October 2026 · AIORCA LTD
The short version.We build your site, you check it, it goes live, and we invoice the build the same day. The first 12 months of hosting are included from the day it goes live. After that, Care keeps it hosted and looked after for a yearly fee. We invoice you 30 days before each renewal and remind you before anything is due. You own your content, your domain and, once paid, your site.
These terms apply to every website AIORCA LTD ("we", "us") builds and looks after. Your order form sets out what you are getting and what it costs. The order form and these terms together are our agreement. If they ever disagree, the order form wins.
1What the build includes
- The pages and features listed on your order form, designed for phones, tablets and computers.
- A working contact or enquiry form, page titles and descriptions for search engines, a sitemap and a secure (https) connection.
- Reasonable changes before launch, as long as they stay within the pages and features on your order form. New pages or features are quoted before we start.
- The first 12 months of hosting and Care, starting on the day the site goes live.
2What we need from you
- Your content. You are responsible for what your site says being accurate and lawful. That includes prices, qualifications, professional memberships, reviews and any claims about results.
- Your photos. You confirm you have the right to use any photos, logos or text you give us.
- Your privacy notice. If your site collects personal details (an enquiry form does), you need a privacy notice. We can give you a starting template, but it has to be right for your business, so it is your responsibility.
- Timely replies. Timelines run from when we have your content and answers, not from the day you agree.
3Paying for the build
- We invoice the build on the day your site goes live. It is due within 7 days.
- Payment is by bank transfer, using the invoice number as the reference. We send a receipt when it lands. If you would rather pay by card, ask and we will send a secure payment link.
- We are not VAT-registered, so no VAT is added.
- The site runs on our server until it is paid for. If the build invoice is not paid, we may take the site offline after giving you 7 days' written notice. It comes back as soon as the invoice is paid.
- If a business invoice is paid late, we may claim interest and recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998. We would always talk to you first.
4Going live
Once you have signed off the finished site, we send you (or whoever looks after your domain) the exact settings to point the domain at your new site. We do not need access to your domain account and we never transfer a domain away from you. Your email stays where it is unless we agree otherwise. The day the new site is live is your go-live date, and it is what all renewal dates are counted from.
5Care: hosting and looking after your site
Care covers:
- Hosting on our server, the secure (https) certificate, regular backups and uptime monitoring.
- Security and software updates.
- Small changes, sent by email or WhatsApp. A small change is an update to existing content: wording, prices, opening hours, swapping a photo, adding or removing a line or a link. Small changes are included.
Bigger jobs, such as a new page or section, a redesign, a booking or shop system, or new features, are not small changes. Unless your order form or monthly plan includes them, we tell you the price before we start, and nothing is done until you say yes.
6Renewals
- Your first 12 months of Care are included in the build. Care then renews every 12 months on the anniversary of your go-live date, at the price on your order form.
- We invoice you 30 days before each renewal date, and the invoice is due on the renewal date. We send a reminder about a week before if it is still open.
- If the price is going to change, we tell you in writing at least 30 days before the renewal. You can cancel before the new price applies.
7If a renewal is not paid
- Your site stays live for 30 days after the renewal date while we get in touch.
- After that, we may pause the site (show a holding page instead) after giving you 7 days' written notice. It comes back as soon as the invoice is paid.
- We keep your site files for at least 60 days after a pause, and we will tell you before anything is deleted. You can ask for them at any time.
8Monthly plans
Monthly plans (for regular updates and search work) are optional and sit on top of Care. They are paid monthly in advance by standing order to our business bank account. We send the details when the plan starts, and card payment is available on request. You can cancel at any time, and the plan stops at the end of the month you have paid for.
9Cancelling
- You can cancel Care at any time by email. It runs to the end of the year you have paid for. Part-years are not refunded.
- When you leave, we give you your site files and help you move them, at no charge. Your domain was always yours.
- We can end Care by giving you at least 60 days' written notice, and we will still hand over your files.
10Who owns what
- Your content, photos, logo and domain are yours throughout.
- Once the build invoice is paid, the finished site is yours. Some of the building blocks we reuse across sites (our own code, components and tools) stay ours, and you get a permanent licence to use them as part of your site.
- We may show your site in our portfolio, without any personal details. Tell us if you would rather we did not.
11Your customers' data
When people use the forms on your site, their details pass through systems we run. For that data you are the controller and we are your processor under UK GDPR. This means we:
- only use it to deliver your site and its forms, on your instructions, and never for anything of our own;
- keep it confidential and make sure anyone working on it is bound to confidentiality;
- keep it secure, with access limited to what the work needs;
- use only the services needed to run your site (our hosting provider, our email provider and our automation provider), on terms that protect the data in the same way. We will tell you before adding or changing one, and you can object;
- help you respond if someone asks to see or delete their data, and with any security or data protection questions you have to answer;
- tell you without undue delay if we become aware of a breach affecting it;
- delete or return it when our agreement ends, unless the law requires us to keep it;
- give you the information you need to show we are meeting these obligations.
Your forms should only ask for what you need. If you work in health, therapy or wellbeing, we recommend your enquiry form does not ask people to describe their health or circumstances. That conversation is better kept for your first call.
12Liability
- We build and look after your site with reasonable care and skill.
- We cannot promise particular search rankings, enquiries or business results, and we are not responsible for outages or changes at services we do not control.
- We are not liable for indirect losses such as lost profit or lost opportunity. Our total liability is limited to the fees you have paid us in the 12 months before the claim.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.
13Changes to these terms
If we update these terms, the version you accepted keeps applying until your next renewal. We tell you about any new version at least 30 days before it would apply to you. Every version stays published at its own address.
14Law
These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction.
15Agreeing
You accept these terms and your order form by replying "I agree" to the email we send them with, or by signing the order form. We record the date and the terms version you accepted.
