Terms of service

These terms apply to work carried out by AI ORCA LTD (registered in Scotland, company number SC884036) unless we have signed something different with you.

Quotes and scope

Every quote lists what is included and, just as importantly, what is not. Work outside that list is quoted separately before it starts — we will not do extra work and surprise you with a bill, and we will not absorb it silently either. If you ask for something mid-project we will tell you at the time whether it is inside scope.

Payment

• Builds are normally 50% to start and the balance on approval, unless the quote says otherwise.
• Care plans are monthly in advance and you can cancel any time — no notice period, no minimum term.
• The £49 Full Audit is paid up front. It is credited in full against a build if you commission one within 30 days.
• Invoices are due within 14 days.

The £49 Full Audit

You get a written audit of your site delivered within two working days of payment. It reports what we find; it does not fix anything. It is carried out from the outside — we do not need, and will not ask for, access to your systems. If we cannot reach your site at all, we will tell you and refund you.

Timelines

Quoted timelines start from the day we have both the access and the content we need — not from the day you pay. The single most common cause of a late project is waiting on copy and photos, so we will chase you for them, and we would rather record you talking for forty minutes and write it up ourselves than leave a page empty.

What we need from you

Delegated access, not ownership. We ask to be added as a user on your domain, hosting and other accounts so we can do the work; you keep ownership of everything throughout and can remove our access the day we finish. We will never transfer a domain away from you.

Ownership

Once you have paid in full, the website, content and assets we produced for you are yours. Anything we bring with us — our own components, templates and internal tooling — stays ours, and you get a licence to keep using it as part of your site for as long as you like.

Third-party services

Some deliverables depend on services we do not control, such as hosting, payment processors, email providers and automation platforms. We will tell you which ones a build depends on and roughly what they cost. Their prices and terms are theirs, not ours.

Cancellation

You can stop a project at any point. You pay for the work completed to that date and we hand over what exists. Deposits cover work already begun and are non-refundable once the work has started.

Liability

We do everything we reasonably can to make what we build correct, secure and fast, but we cannot guarantee particular business results — no honest agency can. Our liability for any claim is limited to the fees you have paid us for the work in question. Nothing here limits liability for death, personal injury, or fraud.

Governing law

These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction.
